Law on Parking Vehicles on Public Roads that Disturb Other People

You are not allowed to park your vehicle on a public road so that it disturbs other people. By blocking traffic, making it difficult to pass, causing traffic jams, or the like. Actions like this include disturbing fellow Muslims. But God Story said,

And those who harm believers, both men and women, other than what they have earned, they have indeed committed slander and committed sin.

“And those who disturb those who believe and those who believe without any fault they have committed, then indeed they have borne a lie and a clear sin.” (QS. Al-Ahzab: 58)

From Abdullah bin Umar May Allah bless him and grant him peaceProphet May Allah bless him and grant him peace said,

O people who entered Islam with their tongues but their faith did not enter their hearts, do not harm the Muslims.

“O people who have converted to Islam, but faith has not yet entered their hearts, do not disturb your fellow Muslims.” (HR. Tirmidhi no. 2032, recommendation of Al-Albani in Sahih At-Tirmidhi)

Especially if the neighbor who feels disturbed by the vehicle being parked incorrectly is the neighbor, then the sin is even greater. From Abu Hurairah May Allah bless him and grant him peaceProphet May Allah bless him and grant him peace said,

By God, he didn’t believe it. By God, he didn’t believe it. By God, he didn’t believe it. They asked, “What is that, O Messenger of Allah?” His neighbor said, “His neighbor is not safe from his disaster.” They asked, “O Messenger of Allah, what are the misfortunes?” He said, “The crime.”

By Allah, (he) does not believe. By Allah, (he) does not believe. By Allah, (he) does not believe. The companions asked, “Who is that, O Messenger of Allah?” The Prophet answered, “People whose neighbors feel insecure about their Bawaiq.” The companions asked, “What is that, O Messenger of Allah?” The Prophet answered, “The worst.” (HR. Ahmad, 14: 262. Ratified by Al-Albani in Sahih At-Targhib NO. 2550)

Trying not to interfere with the path of Muslims is one of the consequences of faith. So disturbing the road is something that destroys faith. From Abu Hurairah May Allah bless him and grant him peaceRasulullah May Allah bless him and grant him peace also said,

Faith has seventy-five – or sixty-five – branches, the best of which is to say there is no god but Allah, and the smallest of which is to eliminate corruption in the path.

“Faith has seventy branches, the most important is the word laailaha illallah, and the lowest is removing distractions from the path.” (HR. Muslim no. 35).

Sheikh Salih bin Fauzan Al-Fauzan hafizhahullah explain,

“It is not permissible to disturb Muslims on the road they are on, in fact it is obligatory to make the road clear and remove disturbances from the road. Therefore, removing disturbances from the road is part of faith, as reported by the Prophet May Allah bless him and grant him peace.

It is not permissible for a person to build something within his or her ownership area that could interfere with the road, such as building a roof over the road that blocks the passage of vehicles or animals carrying goods, or building a platform for seating that juts out into the road.

He must not use a public road as a place to park his riding animal or car, because this can narrow the road or cause an accident.

Shaykhul Islam Ibn Taymiyyah God bless say,

It is not permitted for anyone to bar Muslims from any part of the building. Even walls are prohibited from being plastered. Unless the master of the wall enters its borders that thick

“It is not permissible for a person to make something on a part of his building so that it protrudes into the Muslim road. He is even prohibited from covering the walls with plaster unless the plaster is still within the boundaries of his own land according to its thickness.”

Likewise, on public roads, it is not permitted to plant disturbing trees, build, dig, put firewood, slaughter animals, throw rubbish, throw ashes, and other things that could endanger road users.” (Al-Mulakhas Al-Fiqhi2: 113)

Solutions for those whose vehicles are often parked on public roads include:

• Build a garage on your own land, even if you have to sacrifice some of the house area and reduce a little comfort.
• Rent another house to park the vehicle.
• Rent a parking space that does not interfere with the road.
• Replacing the vehicle mode with one that is more suitable for the land owned.
